DALLAS - The excessive court will allow a wrongful dying lawsuit to proceed towards the city of Dallas and four police officers.

The family of a man who died in police custody in 2016 sued.

Tony Timpa called police for assist as he had a drug and mental well being disaster.

The town fought towards releasing physique digicam video and whit it did come out it was obvious why. It showed the officers mocking the dying man.

One had his knee on Timpa’s back and neck for almost 15 minutes and the health worker said that contributed to his demise.

The city of Dallas argued the officers are legally shielded from lawsuits.

The Supreme Courtroom upheld a federal appeals court’s ruling that will allow the case to proceed.

"The decision signifies that the case can proceed to trial and that there will likely be no extra delays from any appellate courtroom. Also, the choice signifies that the Fifth Circuit did it proper that their ruling relating to lethal pressure will be the law of the land a minimum of in Mississippi, Texas and Louisiana for so long as we know," said Geoff Henley, an attorney for Timpa’s household.

Those are the states covered by the Fifth Circuit Courtroom of Appeals ruling allowing the suit to continue.

Three years ago, the Dallas district lawyer dropped criminal fees against three of the officers.
